Applicable Law
This Policy is governed by the laws of the State of Ohio, without regard to its conflict of laws principles. Jurisdiction for any claims arising under or out of this Policy shall lie exclusively with the state and federal courts within the State of Ohio. If any provision of this Policy is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision will be eliminated or limited to the minimum extent such that the remaining provisions of these terms will continue in full force and effect and in the manner most favorable to Gardner, Inc.

Processing Purpose(s) – Processing orders (including collecting payment and sending invoices), delivering products/services, responding to inquiries, management of customer purchases and accounts, compiling details of user engagement, sending marketing materials (including offers and other information we feel may be of interest to you), administration of
contests and surveys, processing job applications and Human Resources Data for purposes of administration and communication, and to comply with labor law requirements.

▪ Processing Purposes – Processing orders (including collecting payment and sending invoices), delivering products/services, responding to inquiries, management of customer purchases and accounts, compiling details of user engagement, sending marketing materials (including offers and other information we feel may be of interest to you), and administration of contests and surveys.


Internet or Network Activity
▪ Examples – Type of browser you are using, terms you enter into the search functions of our Websites, information on a Consumer’s interaction with a website, application, or advertisement, and the websites you visit immediately before and immediately after you visit our Websites.


▪ Processing Purposes – To evaluate consumer trends and usage related to our Websites and allows us to improve our Website content and offerings accordingly, and sending marketing materials (including offers and other information we feel may be of interest to you).

 

Information Not Included
▪ Publicly Available Information – “Publicly available” information means information in any form that is generally accessible, without restriction, to the public.

▪ Deidentified or Aggregate Information – “Deidentified Information” means information that cannot reasonably identify, relate to, describe, be capable of being associated with, or be linked, directly or indirectly, to a particular individual. “Aggregate Information” means information that relates to a group or category of individuals, from which individual identities have been removed, that is not linked or reasonably linkable to any individual or household, including via a device.

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by certain members of the Company to third parties for the third parties’ direct marketing purposes. Requests may be made one time per calendar year. Right to Know and Data Portability

Right to Delete
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions (the "right to delete"). Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
▪ Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.

▪ Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
▪ Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
▪ Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
▪ Comply with a legal obligation.
▪ Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

 

We will delete or deidentify personal information not subject to one of these exceptions from our records and will direct our service providers to take similar action.


Right to Correct Inaccurate Personal Information
You have the right to request that we correct any inaccurate personal information that we maintain about you (the "right to correct inaccurate personal information").


Exercising Your CCPA Rights

Only you, or someone legally authorized to act on your behalf, may make a request to know, correct or delete related to your personal information.

You may only submit a request to know twice within a 12-month period.

Your request must:
▪ Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
▪ Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

 

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

 

You do not need to create an account with us to submit a request to know or delete. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.

 

We will only use personal information provided in the request to verify the requestor's identity or authority to make it.

 

Response Timing and Format
We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact us at 1-800-GARDNER.

 

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

 

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response electronically.

 

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

 

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

 

Personal Information Sales Opt-Out and Opt-In Rights
If you are age 16 or older, you have the right to direct us to not sell or share your personal information at any time (the "right to opt-out"). We do not sell or share the personal information of consumers we actually know are less than 16 years old. Consumers who opt-in to personal information sales or sharing may opt-out of future sales or sharing at any time.
